Terms of Use

1. License Grant

Subject to your compliance with these Terms and payment of applicable fees, iSync grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on devices you own or control for your personal or internal business purposes.

Free Trial licenses are limited to the features and usage quantities described on the pricing page. Pro licenses are granted per individual user. Lifetime licenses are granted to a single individual and may not be resold or transferred.

2. Permitted Uses

You may use the Software for the following legitimate purposes:

• Protecting your location privacy by simulating a virtual GPS position
• Testing location-based features in apps you are developing
• Travel planning and virtual exploration of geographic areas
• Route simulation for navigation planning and demonstration
• Using location-based app features in a virtual context
• Educational and research purposes related to GPS and location technology

3. Prohibited Uses

You may not use the Software in any way that violates applicable laws, infringes on third-party rights, or violates the terms of service of any third-party application. Without limiting the foregoing, you agree not to:

• Use the Software to commit fraud, deception, or to facilitate illegal activity
• Violate the terms of service of any third-party app or platform while using the Software
• Use the Software to harass, stalk, or harm any individual
• Reverse engineer, decompile, or disassemble the Software
• Redistribute, resell, sublicense, or transfer the Software to any third party
• Use the Software in any manner that could damage, disable, or impair our servers or infrastructure
• Attempt to circumvent any licensing, activation, or access control mechanism
• Create derivative works based on the Software without our prior written consent

4. Intellectual Property

The Software, including all source code, graphics, user interface design, documentation, and related materials, is the exclusive property of iSync and is protected by copyright, trademark, and other intellectual property laws. The name "iGlide LocationChanger," "GPS Route Explorer," and "iSync" are trademarks of iSync. You are not granted any rights in these trademarks by these Terms.

5. Payment and Subscriptions

Pro subscriptions are billed monthly or annually as selected at purchase. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period; you retain access through the period you have paid for.

Lifetime licenses are one-time purchases that grant permanent access to all Pro features at the time of purchase, plus updates for the lifetime of the product. Lifetime licenses do not include features added as part of future major version releases that are offered as separate products.

6. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPATIBLE WITH ALL DEVICES OR iOS VERSIONS. YOUR USE OF THE SOFTWARE IS AT YOUR SOLE RISK.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ISYNC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SOFTWARE. IN NO EVENT SHALL ISYNC'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to indemnify, defend, and hold harmless iSync and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Software, your violation of these Terms, or your violation of any rights of another party.

9. Termination

We may suspend or terminate your license at any time if you violate these Terms. Upon termination, you must cease all use of the Software and delete all copies from your devices. Provisions that by their nature should survive termination (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Governing Law) will survive.

10. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction for infringement of intellectual property rights.

11. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date and, where appropriate, notifying registered users by email. Your continued use of the Software after the effective date of any changes constitutes your acceptance of the updated Terms.
